Graubünden Forgoes Appeal to the Federal Supreme Court
Graubünden accepts the suspension of wolf culls ordered by the Federal Administrative Court and forgoes an appeal. The regulation period expires.
Canton Accepts Suspensory Effect
The canton of Graubünden accepts the suspensory effect of the complaints filed by three nature conservation organisations against the decimation of wolf packs.
As Graubünden State Councillor Carmelia Maissen (Centre Party) explained on 9 January 2024, the canton will not appeal the corresponding ruling of the Federal Administrative Court to the Federal Supreme Court.
“By the time the Federal Supreme Court had decided, 31 January would have passed and with it the regulation period,” said the head of the Department of Infrastructure, Energy and Mobility at the monthly media briefing of the Graubünden government in Chur.
For this reason, the canton had decided against appealing the ruling. The cantons of Graubünden and Valais had in November 2023 ordered the preventive culling of a larger number of wolves including the elimination of entire packs.
Nature Conservationists Successful with Their Complaint
Previously, they had received the corresponding approvals from the Federal Office for the Environment (FOEN) to hunt these predators until the end of January 2024. Several nature conservation organisations lodged complaints against this.
Federal Administrative Court Rejects Lifting of Suspensory Effect
As is generally customary, this had a suspensory effect. In December, the two cantons submitted a request to lift the suspensory effect on the grounds of the “high extent of damage”. The Federal Administrative Court did not grant this request. “We were unsuccessful with our concern,” said Maissen.
