  • Application procedure as a pre-contractual or contractual relationship (Art. 9 para. 2 lit. b GDPR) – In so far as, within the scope of the application procedure, special categories of personal data within the meaning of Art. 9 para. 1 GDPR (e.g. health data, such as severe disability status or ethnic origin) are requested from applicants in order to enable the controller or the data subject to exercise rights and fulfil obligations arising from employment law and the law of social security and social protection, their processing is carried out pursuant to Art. 9 para. 2 lit. b GDPR; in the case of the protection of vital interests of applicants or other persons pursuant to Art. 9 para. 2 lit. c GDPR; or for purposes of preventive health care or occupational medicine, for the assessment of the working capacity of the employee, for medical diagnosis, the provision of care or treatment in the health or social care sector, or the management of health or social care systems and services pursuant to Art. 9 para. 2 lit. h GDPR. In the case of communication of special categories of data based on voluntary consent, their processing is carried out on the basis of Art. 9 para. 2 lit. a GDPR.

We process personal data for the duration required for the respective purpose or purposes. Where longer retention obligations arise due to legal and other obligations to which we are subject, we restrict the processing accordingly.

Relevant legal bases

In accordance with Art. 13 GDPR, we inform you of the legal bases for our data processing. Where the legal basis is not stated in the data protection declaration, the following applies: The legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR, the legal basis for processing to fulfil our services and to carry out contractual measures as well as to respond to enquiries is Art. 6(1)(b) GDPR, the legal basis for processing to fulfil our legal obligations is Art. 6(1)(c) GDPR, and the legal basis for processing to safeguard our legitimate interests is Art. 6(1)(f) GDPR. In the event that the vital interests of the data subject or another natural person require the processing of personal data, Art. 6(1)(d) GDPR serves as the legal basis.

Security measures

In accordance with the legal requirements and taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the varying likelihood and severity of the threat to the rights and freedoms of natural persons, we take appropriate technical and organisational measures to ensure a level of protection appropriate to the risk.

The measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling the physical and electronic access to the data as well as the access, input, disclosure, assurance of availability and separation relating to it. Furthermore, we have established procedures that ensure the exercise of data subjects' rights, the erasure of data and responses to threats to the data. In addition, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by privacy-friendly default settings.

Transfer of personal data

As part of our processing of personal data, it may happen that the data is transferred to or disclosed to other bodies, companies, legally independent organisational units or persons.
